…for the consideration of the agreement of Kilbride International (KI) and/or Penmerryl Farm (PF) to allow the use of its facilities for horse back riding, motorcycle riding, vehicle operation, and associated activities, and other recreational activities do hereby make this agreement.

I AM AWARE THAT RIDING MOTORCYCLES, DRIVING MOTORCYCLES, RIDING HORSES, DRIVING VEHICLES, RIDING IN VEHICLES, AND OTHER ACTIVITIES INVOLVING HORSES, MOTORCYCLES, AND VEHICLES ARE INHERENTLY HAZARDOUS AND DANGEROUS. I AM VOLUNTARILY PARTICIPATING IN THESE TYPES OF ACTIVITIES AND /OR INSTRUCTION WITH THE KNOWLEDGE OF THE DANGER INVOLVED, AND HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH.(Required)

I am voluntarily participating in the activities described herein, including horse riding, motorcycle riding, bicycling, motorized bicycles/scooters/mopeds, swimming, boating, fishing, hiking, disc golf, camping, tennis, corn hole, feeding animals, spectating any activity, and/or any other activity, and, after being warned of the dangers incident thereto, I agree to use all safety equipment, other equipment, and animals in the manner in which it/they were intended to be used and to employ all suitable precautions and safety equipment available to me.(Required)

I hereby agree that I will not present a suit or claim against KI or PF, their officers, Lessors, agents, leaders, instructors, sub-contractors, or volunteers, for injury, loss, or damage, resulting from my participation in any of the activities described herein, including unauthorized or authorized use of these facilities, or other such activities arising out of my use of said equipment, animals, facilities, or presence on/use of these premises.(Required)

All persons on these premises will be regarded as participants and limited by the inherent risk laws of Virginia § 3.2 6200-6203(Required)

I also hereby agree to release and discharge from liability KI and PF it’s officers, Lessors, employees, agents, instructors, contractors, sub-contractors, and/or volunteers from all actions, claims, or demands, for myself, my heirs, personal representatives, family members, or my ward, if applicable, for death, injury, loss, or damage to property or person resulting from use of aforesaid facilities or participation in the foregoing activities. I further hereby agree to Indemnify and hold harmless any of the above named parties or entities against whom an action is brought or claim made in violation of this agreement. Further, if such a claim is made and found to be non-compensable, I agree to pay the attorney’s fees and any other costs of fees KI, PF or their officers, Lessors, agents, leaders, instructors, sub-contractors, contractors, or volunteers incurred in the defense of such claim.(Required)

I further hereby grant KI and PF or its assigns the permission to use, in any media, my photograph, likeness, video/audio recording, or any other reproduction arising out of the use of the facilities.(Required)
